The box has been set back to factory settings and Dsayers openATV 6 image installed

That's why you shouldn't buy boxes fully loaded. Contact admin but I don't think there is much they can do, probably best cut your losses and request a line from the Virgin server request thread.

July was more than 4 months back - sounds to me like he's sold you his box that did have a year sub, lets not forget he used it for 6 months and July was 6 months ago, seems like year is up.
